Realizar un testamento solidario es una gran manera de contribuir con aquellas causas que te conmueven y que te gustaría apoyar. ¿Qué es un testamento solidario?

En concepto, es muy sencillo: el legado solidario es simplemente un testamento que te permite incluir, además de, por ejemplo, a tus seres queridos, a todo tipo de asociaciones benéficas, como la Fundación Leucodistrofia TUBB4A. La razón de ser de un testamento solidario es destinar una parte de tu legado a ofrecer una ayuda a una organización que trabaja en una causa que te conmueve. Además, si decides efectivamente hacer un testamento solidario, podrás legar lo que tú quieras, desde joyas u obras de artes, hasta dinero en efectivo o acciones.

 

¿A quién puedes beneficiar en un legado solidario?

Aquí el espectro también es amplio, por lo que tienes bastantes opciones entre las que elegir. Las alternativas incluyen proyectos solidarios de protección del medio ambiente, ONGs infantiles, fundaciones de ayuda social y, por supuesto, organizaciones que ayudan en la investigación o erradicación de enfermedades, como es el caso de Fundación Leucodistrofia TUBB4A.

¿Cómo funcionan los testamentos en España?

En España, en términos generales, la ley indica que el testamento se divide en 3 partes:

• Legítima: es la parte que se divide a partes iguales entre los herederos forzosos, tales como los hijos y la viuda o el viudo.

• Mejora: también se destina a los herederos forzosos, pero la diferencia es que quien está realizando el testamento tiene libertad para decidir cómo distribuir

entre ellos este tercio.

• Libre disposición: esta es la porción que el testador tiene disponible para dejar su legado solidario.

 

En el caso de las personas que no tienen herederos forzosos, se puede dejar el total del patrimonio en manos de instituciones y fundaciones benéficas. Se podría declarar a una ONG como heredera universal o se podría repartir el patrimonio entre varias instituciones.

En los casos de personas que no tienen herederos forzosos y no dejan ningún tipo de testamento, el patrimonio pasa al Estado.

Es importante que las instituciones que van a ser beneficiarias de la herencia sean notificadas, para que al momento del fallecimiento sepan que deben reclamar su parte.

Otro punto que hay que destacar es que la mayoría de las fundaciones solidarias no están sujetas al impuesto de sucesiones, por lo que la cuantía destinada por el testador llega de forma total, sin deducciones.

 

¿Cómo se hace un testamento solidario?

Para hacer un testamento solidario lo único que necesitas hacer es pedir una cita en una notaría y redactarlo incluyendo de forma correcta los datos de los beneficiarios y de lo que estás legando. El coste de hacerlo es menor a los 100 €.

encargamos de difundir su existencia, para que más profesionales e instituciones le presten atención, de tal forma que haya más fondos para su investigación. También difundimos y promovemos técnicas de detección temprana de enfermedades de origen genético mediante cribado prenatal y en recién nacidos.
